What is kept when you ask for erasure

It depends on whether there was any transaction.

You can exercise the right to erasure under article 17 of the GDPR. What happens next depends on the account's history.

Accounts with no order or payment

Personal data is erased in full: name, email, phone, address and username. Nothing that could identify the person is kept.

Accounts with orders, payments or invoices issued

TugaFreela is required to keep for 10 years the identification details contained in invoicing documents, under article 52 of the Portuguese VAT Code and article 123 of the Corporate Income Tax Code. In those cases only the minimum necessary is kept:

  • name;
  • tax identification number;
  • email address;
  • country.

The rest — phone, address, username — is erased.

The basis

This retention rests on compliance with a legal obligation, expressly reserved in article 17(3)(b) of the GDPR. Once the legal period ends, the data is erased or anonymised.

This is not our choice. No platform in Portugal may delete the identification details on an invoice already issued before ten years have passed.
